Sometimes pursuing a claim to the Employment Tribunal is unavoidable, with the reasons for making a claim ranging from unfair dismissal, to unlawful deduction of wages.

Before submitting an Employment Tribunal Claim, we remind you that most employees will have to pursue a Grievance or an Appeal. More importantly, there are very strict timescales for lodging claims to the Employment Tribunal. Within 3 months less one day of dismissal, resignation or the relevant incident, you must register your claim through early ACAS conciliation. Once early ACAS conciliation has been concluded, you are likely to have only 1 month to submit your claim to the Employment Tribunal.

The process of submitting and advancing an Employment Tribunal Claim is now very complicated. Whilst employees can represent themselves, it is not advisable. In our opinion and experience, the choice of solicitor is very important. You should choose someone experienced in representing individuals, and who you can trust will do the best possible job on your behalf. Instructing a law firm who are known for representing mostly employers may not be the best option.
